Scan 'failed' because 1 out of 1000 files wasn't copied - how to change trigger/rule?

Hi guys,

We have millions of files and thousands change/ get added every day. Sometimes a user is still working on a file when the backup runs.
This triggers the error "The process cannot access the file because it is being used by another process" and this in turn marks the job 'failed'.

But in our case we are not that concerned if one file doesn't get copied that night because it will be copied the night after.
But having the job marked as 'failed' triggers an email and scares the s*** out of me because there is no way of telling whether the whole backup failed or just that one insignificant file wasn't copied (unless looking at the log files but that is too ).

The files are not local so I can't prevent that error from happening.

Is there a way to tell SBPro that 'I don't care about that error' - meaning: don't flag it up when this error is occurs?
Or some setting where it only marks a job as failed when more than 1% of the files have not been copied successfully?
